50% Tariff on Certain Canadian Products Starting August 19, 2026

President Trump announced three proclamations imposing a 50% tariff under Section 338 of the 1930 Trade Act on certain Canadian products, effective 12:01 a.m. ET on August 19.


Impacted Canadian product imports and HTS numbers:

  • Proclamation, "IMPOSING ADDITIONAL DUTIES TO OFFSET CANADIAN DISCRIMINATION AGAINST THE COMMERCE OF THE UNITED STATES WITH RESPECT TO DAIRY,” Annex 1 and Annex II;
  • Proclamation, “IMPOSING ADDITIONAL DUTIES TO OFFSET CANADIAN DISCRIMINATION AGAINST THE COMMERCE OF THE UNITED STATES WITH RESPECT TO ALCOHOLIC BEVERAGES,” Annex I and Annex II;
  • Proclamation, “IMPOSING ADDITIONAL DUTIES TO OFFSET CANADIAN DISCRIMINATION AGAINST THE COMMERCE OF THE UNITED STATES WITH RESPECT TO MOTOR VEHICLES,” Annex 1 and Annex II.


The tariffs target Canadian dairy products, alcoholic beverages, and motor vehicles, each in response to specific Canadian trade restrictions.


Annexes in the proclamations list the impacted Canadian product imports and HTS numbers.


This is the first use of Section 338 tariffs, with no specified time limit or removal of conditions in the law. There is no USMCA exemption from these tariffs as the provision has never been used before.

Reminder: English Language Documentation Requirements for Import Entries

U.S. Customs and Border Protection (CBP) is committed to facilitating the efficient flow of trade. To ensure timely processing, we remind the trade community that all documentation submitted for entry must be in the English language.


CBP officers must verify the nature, value, and admissibility of goods to fulfill statutory responsibilities. Documentation submitted in a foreign language hinders this process.


General Imports: Pursuant to 19 CFR 141.86(b) and 19 U.S.C. 1484, all commercial invoices and supporting entry documentation must be in English or accompanied by an accurate English translation.


Regulated Commodities: For imports subject to USDA oversight, 9 CFR Parts 93, 94, 95, and 96 explicitly require that official certificates, permits, and declarations be provided in English.


To avoid processing delays or Requests for Information (RFIs), please ensure all foreign-language documents include an accurate English translation upon submission. Providing clear, English-language documentation allows CBP to verify compliance efficiently and supports the timely release of your goods.
